Terms of Service

1. Acceptance of Terms
By accessing or using Prompt2CAD ("Service"), operated at prompt2cad.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
Prompt2CAD is a web-based tool that uses artificial intelligence (Google Gemini) to generate parametric 3D models from natural language descriptions. Users can view, adjust, and export models in various CAD and 3D formats (STEP, DXF, OBJ, STL, GLB, DAE) as well as PNG images and photorealistic renders.
3. Accounts & Authentication
You may sign in using Google authentication. You are responsible for maintaining the security of your account credentials. You must not share your account or allow unauthorized access.
4. Credits & Billing
- New users receive 120 free trial credits on first sign-in.
- Additional credits are available via pay-as-you-go top-ups through Stripe. The minimum top-up is $10.00 (1,000 credits, at a rate of 1 cent per credit).
- Credits are consumed at fixed rates per action: 30 credits for a new model generation, 15 credits for a refinement (iteration), and 50 credits for a photorealistic render. Multi-step actions within a single chat turn do not consume additional credits. Parameter adjustments (sliders) and PNG screenshots are always free.
- Chat turns that fail before producing usable output are not charged, even though they are logged for diagnostic purposes.
- Exports to CAD and 3D formats (STEP, DXF, OBJ, STL, GLB, DAE) are gated behind a one-time paid threshold. Once any top-up has been completed, exports remain unlocked for the lifetime of the account. PNG exports are always available regardless of payment status.
- Credits are non-transferable. Unused credits do not expire.
- Refunds for purchased credits may be requested within 14 days of purchase, provided the credits have not been consumed. Consumed credits are non-refundable.
- We reserve the right to change pricing with reasonable notice.
5. User Content & Intellectual Property
You retain full ownership of the designs, models, and exported files you create using the Service. We claim no intellectual property rights over your content.
By using the Service, you grant us a limited license to process your inputs (text descriptions, uploaded images) solely for the purpose of generating your requested 3D models.
6. AI-Generated Content
Models are generated by AI and may contain inaccuracies, structural inconsistencies, or unintended similarity to existing third-party designs. The Service is a design exploration tool — it does not replace professional engineering, design, or legal review. You are responsible for:
- Verifying the suitability, accuracy, and safety of any design before manufacturing, construction, or commercial use.
- Ensuring that designs you generate, export, manufacture, or distribute do not infringe the intellectual property rights of third parties (including but not limited to protected industrial designs, trademarks, copyrights, and registered design rights) before any publication or commercial exploitation.
- Complying with applicable building codes, safety regulations, and product-conformity standards in your jurisdiction.
7. Data Storage
Your projects (designs, conversation history, parameters, checkpoints, and renders) are stored locally in your browser's IndexedDB database. For signed-in users, project metadata and geometry are also synced to our servers (Cloudflare D1) so the same projects are accessible across devices when you sign in. Checkpoints and cached renders are local-only and do not sync.
You can export your designs at any time. Clearing browser data will remove the local copy; signed-in users can recover synced projects by signing back in. Account-level data deletion (projects, transactions, email subscriptions) can be requested by contacting us.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to reverse-engineer, exploit, or circumvent billing or usage limits.
- Transmit malicious code or interfere with the Service's operation.
- Use automated scripts to access the Service outside of normal use.
9. Service Availability
The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service at any time with reasonable notice.
10. Limitation of Liability
To the maximum extent permitted by law, Prompt2CAD and its operators shall not be liable for any damages arising from your use of the Service, including but not limited to direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data. You use the Service entirely at your own risk.
11. Indemnification
You agree to defend, indemnify, and hold harmless Prompt2CAD and its operator from and against any third-party claims, damages, liabilities, costs, and reasonable legal expenses arising out of or related to:
- The content, prompts, reference images, or other materials you submit to the Service.
- Any output you generate, export, manufacture, distribute, publish, or commercialise using the Service.
- Your infringement of any third-party intellectual property right, trademark, registered design, or other protected interest.
- Your violation of these Terms, applicable law, or the rights of any third party.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate with us in asserting any available defenses. Nothing in this clause limits any rights you may have as a consumer under mandatory law applicable in your country of residence.
12. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Any remaining purchased credits may be refunded at our discretion.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes constitutes acceptance of the updated Terms.
14. Force Majeure
We are not liable for any delay or failure in performance caused by events beyond our reasonable control, including acts of God, war, civil unrest, government actions, natural disasters, pandemics, infrastructure failures, internet or telecommunications outages, and outages or failures of the third-party services on which the Service depends (including but not limited to Google, Stripe, Cloudflare, Resend, and PostHog).
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Portugal. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent Portuguese courts. Nothing in this clause limits the rights of consumers residing in the European Union to bring proceedings in their country of residence or to invoke mandatory consumer protection law applicable in their country of residence.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or, if no such modification is possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
